OHADAC arbitration presentation during the Colloquium of the African Academy for International Law Practice, 26 February 2020 in Paris, France

  • The team in charge of implementing the OHADAC project has confirmed its participation to the Colloquium of the African Academy for International Law Practice, held at the Gide Law Offices last February 26th from 9h15 to 18h, in memory of Professor Doumbe-Bille, on the theme “Evolution and adaptation to investment and arbitration law in Africa”.
  • This symposium focused on the articulation between the African legal framework and the transnational arbitration law. It gave a perspective of the regulatory consolidation of arbitral proceedings in Africa together with the “nerve sprouting” of the new arbitration and integration institutions that are emerging within the Free Trade Zone of Continental Africa. This represents the opportunity to harmonise the commercial environment and in particular dispute resolution methods throughout the Continent.
  • During this colloquium various key-note speakers and experts intervened as well as inter-state senior officials of the Continent and international organisations such as OECD and UNCITRAL.
  • The panels tackled the following issues:
    1. Challenges and investment opportunities in Africa
    2. International arbitration changes in Africa
    3. The new actors and stakeholders of international arbitration

    In this last panel, the OHADAC objectives for the second phase of its existence were addressed, this is to say the creation of the Arbitration and Mediation Centre “CARO” and the follow-up stage and the process of legislative harmonisation.

    The OHADAC approach on arbitration was thus presented as well as the considered contribution by OHADAC to launch a reform of the international system of dispute settlement in the field of investment in complementarity with the work conducted within the group III of UNCITRAL.
