A Podcast with the “Caribbean ADR Initiative” (CADRIn)

A podcast has been recorded by Marie-Camille Pitton, in charge of the creation and development of the OHADAC Regional Arbitration Centre (CARO), as part of the second phase of the OHADAC project, in partnership with the Chamber of Commerce and Industry of the Guadeloupe Islands (CCIIG) and the ACP Legal association.

This podcast was recorded in the context of a familiarisation campaign conducted for the key Caribbean actors and stakeholders involved in the use of alternative dispute resolution methods (*MARDs), directed by “Caribbean ADR Initiative” (CADRIn). This initiative was launched in 2020 by Shan Greer and Baria Ahmed, both specialised lawyers in alternative dispute resolution settlements, and also acting as mediator and arbitrator.

More recently, this initiative consisted in conducting training activities, presentation seminars, interviews and thematic workshops for government representatives or public bodies, businesses, training centres and in general for any professional interested in developing these techniques within the Caribbean region.

The common denominator of these actions is to adopt a practical approach in order to highlight the concrete benefits and challenges likely to ge gained by different actors advocating a more systematic use of alternative dispute settlement methods ADSMs, and also providing a framework to choose the most suitable technical solution adapted to their needs.

The podcast recorded with OHADAC dealt with the role of institutions in the arbitration administration. This issue was tackled from a general point of view by establishing a comparison between institutional arbitration and the ad hoc arbitral proceedings; and also from the prespective of the future opening of the CARO Centre, with premises soon accessible at the World Trade Centre (CWTC) in Guadeloupe. The specificities of services offered by the CARO Centre where duly highlighted in this particular context. Moreover key topical issues were addressed such as dematerialisation of arbitral proceedings, deadline issues and the means to achieve a more diverse panel of arbitrators and mediators.
