Notification of the first arbitral award based on OHADAC Arbitration Rules

The team in charge of implementing the OHADAC project is pleased to announce that the first arbitral award based on the OHADAC arbitration Rules for ad hoc procedures has been rendered on 1 October 2020.
This award resolves a dispute between two companies from Guadeloupe, in the context of the acquisition of a business.
The sole arbitrator jointly designated by the parties proceeded to resolve the dispute in equity, in accordance with the parties' express choice.
The procedure was conducted in compliance with the delays agreed to between the parties, ensuring the previsibility of costs throughout the procedure.
Shortly after being appointed, the Sole arbitrator invited the parties to review the state of preparation of their case and agree on the modalities of conduct of the procedure, which led to an in-depth discussion during the first hearing.
The Sole arbitrator also gave the possibility to the parties, further to this first hearing, to settle their case.
This first procedure was conducted in a transparent manner, favouring the principles of judicial economy, flexibility and dialogue. These principles will guide the activity of the Center in the months to come.
